Disclaimer in accordance with Art 13 of the General Data Protection Regulation ("GDPR")

This disclaimer describes how PROOF-ACS GmbH, Gottlieb-Daimler-Str. 1, 28237 Bremen, Germany, ("we") is processing your personal data.

1. General

When processing your personal data, we consider data security and confidentiality of your personal data to be our top priority. We process your personal data at all times in accordance with the applicable data protection provisions and in particular with Regulation (EU) 2016/679 dated 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation; "GDPR"). In the following paragraphs we will inform you on how we handle your personal data, including but not limited to the processing and the transfer of this data as well as your claims and rights. Personal data comprises all data on which basis a person can be identified directly or indirectly. For the protection of personal data we apply only up-to-date protection standards.

2. Purpose Limitation

We collect and process only such personal data which is necessary for the performance of a contract to which you are party or in order to take steps at your request prior to entering into a contract (Art 6 para 1 lit b of the GDPR) or which you have provided us on a voluntary basis (Art 6 para 1 lit a of the GDPR).

Furthermore, we process your personal data in accordance with Art 6 para 1 lit f of the GDPR. In this case, our legitimate interest is to ensure the operation of our business and to improve the functionalities of our website.

If you have given us your consent to the processing of your personal data pursuant to Art 6 para 1 lit a of the GDPR, you may withdraw your consent at any time. Such withdrawal does, however, not affect the lawfulness of our data processing up to the time of your withdrawal.

3. Personal Data

Personal data within the scope of the GDPR is all data which contains information on personal or factual circumstances, such as

  • telephone-number, and/or
  • date of birth.

4. Cookies / Server Log Files

For optimised system performance, user friendliness and the provision of useful information on our services, the website provider automatically collects and stores so called server log files, which your browser automatically transmits to us. This information includes your IP address, browser and language settings, operating system, referrer URL, your internet service provider, and the date/time of your visit.

This data is not pooled with sources of personal data. We reserve the right to examine this data later on if there is solid evidence, which suggests unlawful use.

This website uses "cookies" to ensure that our services are user-friendly and more effective for our clients. Any Processor will be obliged by us to treat your data in accordance with the applicable data protection provisions. In particular, any Processor will be obliged to treat your data strictly confidential.

If a processing is performed by the Processor, this will only be allowed, if the Processor provides for adequate guarantees that your personal data will be protected by appropriate technical and organisational measures.

6. Duration of storage

We store your personal data only for such period which is required for the fulfilment of the purposes of each data processing. The respective period of data storage depends also on statutory storage requirements and statutory periods of limitation for potential claims. If the purposes of processing as provided for in this Disclaimer cease to exist, your personal data will be routinely erased.

7. Rights of the data subject

7.1 Right of access by the data subject

You have the right to information on your stored personal data, on their origin and recipients, the duration of storage, and the purpose of data processing (Art 15 GDPR).

7.2 Right to rectification

If we process inaccurate or incomplete personal data, you have the right to rectification or completion of such data.

 

7.3 Right to erasure

You may also request us to erase data, if one of the reasons stated in Art 17 of the GDPR apply.

This includes inter alia the following reasons:

  • the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; and/or
  • the data subject has withdrawn his/her consent for the data processing and where there is no other legal ground for the data processing; and/or
  • the data subject objects to the processing; and/or
  • there are no overriding legitimate grounds for the processing.

7.4 Right to restriction of processing

You have the right to obtain restriction of processing if one of the reasons stated in Art 18 of the GDPR apply. Accordingly, the restriction may be admissible, if the processing is unlawful and you oppose the erasure of your personal data and request the restriction of their use instead, or you have objected to processing pursuant to Art 21 para 1 of the GDPR pending the verification whether our legitimate grounds override yours.

 

7.5 Right to data portability

You have the right to receive your personal data which you have provided to us, in a structured, commonly used and machine-readable format (pursuant to Art 20 of the GDPR). You have the right to transmit those data to another controller without hindrance from us if

  • the processing is based on consent or contract pursuant; and
  • the processing is carried out by automated means.

7.6 Right to object

You have the right to object the processing of your data concerning you at any time, on grounds relating to your particular situation. We shall no longer process your personal data unless we are able to demonstrate compelling legitimate grounds for the processing which override your interests, rights or freedoms or for the establishment, exercise or defence of legal claims.

 

7.7 Right to lodge a complaint with a supervisory authority
